Dear Mr. Miklavic

The following will confirm our conversation regarding the transfer of probationary employees pursuant to Article 8, paragraph J of the fleet service contract.

The Company will consider transfer requests on a case-by-case basis from probationary employees meeting the following criteria:

• Completion of 45 active workdays of the 90-day probationary period
• Employee has maintained a good work record
• The employee’s transfer does not adversely affect staffing requirements in the vacating position

Based on these criteria, the Company reserves the right to approve transfers for probationary employees.
